DMCA Policy
Nexplay respects copyright and responds to properly made infringement notices concerning content on nexplay.gg.
Send notices to [email protected] with "DMCA Notice" in the subject line.
What a Valid Notice Must Contain
| # | Element | Notes |
|---|---|---|
| 1 | Signature | Physical or electronic, from the owner or an authorised agent |
| 2 | The work infringed | Identify the copyrighted material you own |
| 3 | The material on our site | Specific URL, precise enough for us to locate it |
| 4 | Your contact details | Name, postal address, telephone, email |
| 5 | Good faith statement | That the use is not authorised by the owner, its agent, or the law |
| 6 | Accuracy statement | Under penalty of perjury, that the notice is accurate and you are authorised |
A notice missing any of these may not be actioned. A URL is required. Notices identifying an entire site rather than specific material will be rejected.
What We Do With a Valid Notice
We review it, and where the claim appears well founded we remove or disable access to the material, usually within five business days. Every notice received and every action taken is recorded.
Counter Notices
If your material was removed and you believe that was a mistake or a misidentification, send a counter notice to [email protected] with "DMCA Counter Notice" in the subject line, containing:
- Your physical or electronic signature
- Identification of the material removed and where it appeared before removal
- A statement, under penalty of perjury, that you believe in good faith the material was removed as a result of mistake or misidentification
- Your name, postal address and telephone number
- A statement consenting to the jurisdiction of the courts where your address is located, or where the service provider may be found if your address is outside the United States, and that you will accept service of process from the complaining party
On receipt of a valid counter notice we forward it to the original complainant. If they file no court action within ten to fourteen business days, we may restore the material.
False Claims
Knowingly misrepresenting that material is infringing, or that it was removed by mistake, carries liability for damages including costs and legal fees under 17 U.S.C. § 512(f).
We treat notices sent in bad faith as abuse, including notices sent to suppress competing but lawful content. Those are documented and answered accordingly, and repeat senders may be reported to their hosting provider and to the relevant registrar.
Repeat Infringers
We terminate access for contributors who repeatedly infringe copyright.
